1. Agreement to Terms

By downloading, installing, or using FidgetLab ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and FidgetLab ("we," "us," or "our") regarding your use of the App.

2. Description of Service

FidgetLab is a digital fidget toy application that provides:

  • A collection of interactive fidget toys with haptic feedback
  • Customization options for various fidget experiences
  • Usage statistics and tracking features
  • Apple Watch companion app
  • Home Screen widgets

The App is designed for entertainment and stress relief purposes.

3. Eligibility

The App is available to users of all ages. By using the App, you represent that:

  • If you are under 18, you have obtained parental or guardian consent to use the App
  • You will use the App only for lawful purposes
  • You have the legal capacity to enter into these Terms

4. Subscription and Payments

4.1 Free and Premium Features

FidgetLab offers both free and premium features. Free features include a selection of basic fidget toys. Premium features ("FidgetLab Premium") include access to all toys, unlimited customization, advanced statistics, and exclusive content.

4.2 Subscription Options

Premium access is available through:

  • Monthly Subscription: $2.99/month
  • Annual Subscription: $19.99/year
  • Lifetime Access: $49.99 one-time purchase

4.3 Free Trial

New users may be eligible for a 7-day free trial of Premium features. The trial automatically converts to a paid subscription unless cancelled before the trial period ends.

4.4 Billing

All payments are processed through Apple's App Store. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions in your App Store account settings.

4.5 Refunds

Refunds are subject to Apple's App Store refund policy. To request a refund, please contact Apple Support directly through your purchase history.

5. License and Restrictions

5.1 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

5.2 Restrictions

You agree not to:

  • Copy, modify, or distribute the App or its content
  • Reverse engineer, decompile, or disassemble the App
  • Remove or alter any proprietary notices or labels
  • Use the App for any commercial purpose without authorization
  • Attempt to gain unauthorized access to any part of the App
  • Use the App in any way that could damage or impair its functionality
  • Share your Premium subscription credentials with others

6. Intellectual Property

All content, features, and functionality of the App, including but not limited to:

  • Visual designs and user interface elements
  • Sound effects and audio content
  • Haptic patterns and feedback designs
  • Trademarks, logos, and brand elements
  • Software code and algorithms

are owned by FidgetLab and are protected by copyright, trademark, and other intellectual property laws.

7. User Data

Your use of the App is also governed by our Privacy Policy, which describes how we handle data. By using the App, you consent to the practices described in the Privacy Policy.

You are responsible for maintaining the security of your device and any data stored locally by the App.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR COMPLETENESS OF CONTENT

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIDGETLAB SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of profits, data, or other intangible losses
  • Any damages resulting from your use or inability to use the App
  • Any damages resulting from unauthorized access to your data

Our total liability shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

10. Health Disclaimer

FidgetLab is designed for entertainment and general stress relief. It is NOT a medical device and is not intended to:

  • Diagnose, treat, cure, or prevent any medical condition
  • Replace professional medical advice or treatment
  • Serve as therapy for anxiety, ADHD, or other conditions

If you have concerns about stress, anxiety, or any health condition, please consult a qualified healthcare professional.

11. Modifications to Service

We reserve the right to:

  • Modify, suspend, or discontinue any part of the App at any time
  • Add or remove features without notice
  • Update pricing for new subscriptions (existing subscriptions will be honored at their current rate until renewed)

We will make reasonable efforts to notify users of significant changes through the App or our website.

12. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination:

  • Your license to use the App will immediately cease
  • You must delete all copies of the App from your devices
  • Provisions that by their nature should survive termination will remain in effect

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

14. Changes to Terms

We reserve the right to update these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on this page
  • Updating the "Last updated" date
  • Sending a notification through the App for significant changes

Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
